Nasir El-Rufai Temporarily Released for Mother’s Funeral Amid Corruption Trial
The legal saga surrounding former Kaduna State Governor Nasir El-Rufai took a compassionate turn last week as he was temporarily released from custody to attend his mother’s funeral. However, the move has sparked controversy, with critics accusing the Independent Corrupt Practices and Other Related Offences Commission (ICPC) of flouting court orders and showing preferential treatment.
El-Rufai, who faces multiple corruption charges, was released by the ICPC on Friday, October 6, after the death of his mother, Hajiya Ummar El-Rufai, in Cairo, Egypt. Her body was brought to Abuja and laid to rest on Sunday, October 8. While the ICPC described the release as a humanitarian gesture, legal experts and members of the public have questioned whether it undermined judicial authority.
The former governor was initially arraigned on March 24 by the ICPC alongside a co-defendant, facing 10 counts of corruption-related charges. The allegations include fraudulent receipt of inflated severance pay amounting to N579.7 million—far exceeding the N40 million he was reportedly entitled to during his two terms as governor. Additionally, El-Rufai is accused of depositing $817,900 in tranches into his domiciliary account, allegedly derived from corrupt activities.
Following the arraignment, trial judge Ridwan Aikawa ordered El-Rufai to be remanded in ICPC custody pending the hearing of his bail application, originally scheduled for October 10. However, the ICPC chose to release him four days earlier, citing his mother’s passing.
The decision drew sharp criticism from legal circles, with many arguing that it violated the court’s remand order and set a troubling precedent for preferential treatment of high-profile individuals.
Court Proceedings Stall, Bail Hearing Postponed
When El-Rufai returned to court on Tuesday, October 10, proceedings were held under tight security, with journalists barred from entering the courtroom. The bail hearing was unexpectedly postponed to Wednesday, October 11, leaving both the defense and prosecution tight-lipped about the reasons for the delay.
El-Rufai’s lawyer, Ukpong Akpan, briefly addressed reporters, stating, “The hearing of the bail application has been adjourned till tomorrow. I can’t provide further details as we’re filing responses.” Shortly after, the former governor was escorted out of the court premises by ICPC operatives in a white Hilux vehicle.
The ICPC has defended its actions, emphasizing that El-Rufai was promptly returned to custody after the funeral. “He was produced in court on Tuesday as required,” said an ICPC source.
Controversial Release Sparks Public Outcry
Critics argue that the ICPC’s decision to release El-Rufai undermines public trust in the impartiality of anti-corruption agencies. “This sends a dangerous message that the elite are above the law,” said one lawyer, who spoke on condition of anonymity. “The court’s remand order should have been respected regardless of the circumstances.”
El-Rufai’s case has been a focal point of Nigeria’s anti-corruption efforts since his arrest in February. He was initially detained by the Economic and Financial Crimes Commission (EFCC) before being handed over to the ICPC. The latter agency has since filed detailed charges, alleging financial misconduct during his tenure as governor.
The ICPC claims its investigation was prompted by a petition accusing El-Rufai and his administration of mismanaging loans, procurement processes, and government funds between 2015 and 2023. The agency also alleges that the former governor received deposits linked to corruption in his Guaranty Trust Bank account while in office.
Looking Ahead
As the case unfolds, attention will remain on the Federal High Court in Abuja, where El-Rufai’s bail hearing is set to resume. Meanwhile, he faces additional legal challenges, including a separate prosecution by the State Security Service (SSS) over alleged phone-tapping claims involving National Security Adviser Nuhu Ribadu. His arraignment in that case is scheduled for October 23.
The controversy surrounding El-Rufai’s temporary release highlights the delicate balance between justice and compassion in high-profile cases. For many Nigerians, the outcome of this trial will serve as a litmus test for the nation’s commitment to combating corruption—especially among its political elite.
