Santa Fe, New Mexico — In a legal battle with far-reaching implications for Big Tech, New Mexico’s Attorney General Raúl Torrez secured a staggering $375 million verdict against Meta earlier this year, marking one of the largest penalties ever imposed on the social media giant over child safety concerns. But the next phase of the case, set to unfold in a Santa Fe courtroom this week, could prove even more consequential—potentially forcing Meta to fundamentally alter how Facebook, Instagram, and WhatsApp operate, not just in New Mexico but across the United States and beyond.

A Trial That Could Redesign Social Media

Beginning Monday, Meta’s legal team will face off against state prosecutors in a high-stakes three-week public nuisance trial. At issue are sweeping reforms demanded by Torrez’s office, including:

  • Mandatory age verification for all New Mexico users
  • Banning end-to-end encryption for minors under 18
  • Capping minors’ platform usage at 90 hours per month
  • Disabling engagement-boosting features like infinite scroll and autoplay videos
  • Detecting 99% of new child sexual abuse material (CSAM) uploaded to Meta’s platforms

If granted, these measures could set a precedent for other states—or even nations—to impose similar restrictions. “Our goal is to change how this company does business,” Torrez told reporters during a recent advocacy trip to Washington, DC. “A $375 million fine, for a company of Meta’s size, might just be seen as the cost of doing business. We need structural reforms.”

Meta’s Counterarguments and Threats

Meta has fiercely resisted the proposed mandates, warning that some measures—like age verification—could compromise user privacy by requiring intrusive data collection. The company has also hinted at an extreme response: shutting down services in New Mexico entirely rather than complying with what it calls “ill-informed” and “unworkable” demands.

Critics, including cybersecurity experts, argue that stripping encryption from minors’ accounts could backfire. “Forcing kids onto less secure platforms won’t make them safer—it’ll just push them to apps with fewer safeguards,” said Don McGowan, a former board member of the National Center for Missing and Exploited Children (NCMEC).

The Bigger Picture: A Test Case for Tech Regulation

The New Mexico lawsuit is part of a broader wave of legal and legislative action targeting social media’s impact on youth mental health and safety. Over 1,600 similar cases are pending nationwide, including lawsuits by school districts and state coalitions. The outcome in Santa Fe could influence settlement negotiations and embolden other regulators.

Torrez has also taken aim at Section 230, the U.S. law shielding tech platforms from liability over user-generated content. “If companies couldn’t hide behind Section 230, they’d have to justify their design choices to juries,” he argued.

Feasibility and Unintended Consequences

Legal scholars note that even if New Mexico prevails, enforcing the mandates will be complex. How, for instance, would Meta prove it detects “99% of CSAM” without a foolproof method to identify all illicit material? The company has already dismissed the metric as “statistically impossible” in court filings.

Meanwhile, privacy advocates warn that age verification could expose users to data breaches. “Collecting IDs from kids creates new risks,” said Peter Chapman of the Knight-Georgetown Institute. “There are less invasive ways to curb harm, like stopping Meta’s algorithms from connecting minors with suspicious adults.”

A Defining Moment for Digital Governance

The trial represents a rare attempt to regulate tech not through legislation but via courtroom precedent—a strategy with historical parallels to lawsuits against tobacco and opioid companies. “Litigation can force industries to change when politics moves too slowly,” Chapman observed.

Meta, for its part, insists it has already implemented 13 new child safety features in the past year. “Targeting one platform ignores the hundreds of apps teens use daily,” said spokesperson Chris Sgro. “These mandates infringe on parental rights and free expression.”

Yet with New Mexico’s case poised to send ripples through Silicon Valley, the verdict may hinge on a simple question: Should social media companies bear legal responsibility for the harms their products amplify? As the trial unfolds, the world will be watching—and so will the next generation of regulators.

The line between innovation and accountability has never been thinner.
