Zimbabwe Clarifies Farm Returns Under BIPPA Amid Land Reform Transparency Push

Zimbabwe’s government has firmly dismissed suggestions that the recent return of farms protected under Bilateral Investment Promotion and Protection Agreements (BIPPA) signifies a reversal of the country’s land reform programme. Instead, officials have described the move as a strictly legal and constitutional exercise aimed at resolving long-standing obligations tied to international treaties.

Speaking in Parliament on Wednesday, Dr. Anxious Masuka, Acting Leader of Government Business and Minister of Agriculture, Mechanisation, and Water Resources, emphasized that the return of 67 BIPPA-protected farms should not be misinterpreted. He stressed that Zimbabwe’s land redistribution policy remains intact and irreversible, while the BIPPA process focuses on addressing legal claims and compensating investments covered under bilateral agreements.

“The BIPPA process is about settling outstanding legal claims and compensating investments protected under bilateral agreements. It is not a reversal of the land reform programme,” Masuka clarified.

Addressing Land Reform and Tenure Security

The minister explained that the 67 farms represent a small fraction of the land affected by Zimbabwe’s broader land reform initiative, which began in 2000. These farms are being handled in accordance with both the Constitution and international treaty obligations. Meanwhile, the government continues to prioritize strengthening land tenure security for local farmers under President Emmerson Mnangagwa’s administration.

Authorities are in the process of issuing permits, leases, and offer letters to nearly 450,000 black farmers across various farming models. This includes approximately 360,000 A1 farmers, 23,500 A2 farmers, and over 70,000 farmers under the old resettlement scheme. These efforts aim to provide legal recognition and stability for farmers who have long operated without formal documentation.

Correcting Administrative Errors

In addition to these measures, the government is addressing administrative anomalies that have caused confusion over land ownership. Around 840 farms that were incorrectly gazetted are set to be restored to black farmers deemed the rightful owners.

In a significant step toward consolidating indigenous land ownership, title deeds will also be issued to approximately 10,000 Matenganyika farmers whose leases were granted before Zimbabwe’s independence in 1980. This move is expected to provide these farmers with greater legal security and economic empowerment.

A Framework for Former Farm Owners

Masuka also highlighted a new framework for 409 former farm owners who have continued to occupy their properties through peaceful arrangements with resettled farmers. Under this framework, former owners will be allowed to purchase the farms they currently occupy. This approach aims to balance the rights of both former owners and resettled farmers while fostering agricultural productivity.

Balancing Competing Priorities

The clarification comes amid renewed debate over land tenure reforms in Zimbabwe. The government faces the challenge of balancing constitutional obligations, compensation commitments, and the need to boost agricultural productivity. Critics have raised concerns about inconsistencies in land redistribution, while supporters argue that the current measures are essential for resolving historical injustices and attracting foreign investment.

The return of BIPPA-protected farms underscores Zimbabwe’s commitment to honoring international agreements while maintaining its land reform agenda. However, the government’s ability to implement these reforms transparently and equitably will be critical to ensuring long-term stability and economic growth.

As Zimbabwe navigates these complex issues, the focus remains on fostering a fair and sustainable agricultural sector that benefits all stakeholders. With ongoing reforms and increased clarity, the government hopes to build confidence among farmers, investors, and the international community.
