Nasir El-Rufai’s Extended Detention Sparks Outcry Over Rule of Law in Nigeria
Former Kaduna State Governor Nasir El-Rufai remains in custody despite the expiration of a court-ordered detention period, raising concerns over Nigeria’s adherence to the rule of law. The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has faced sharp criticism from legal experts, political leaders, and El-Rufai’s family for what they describe as an unlawful extension of his detention.
El-Rufai was initially granted bail by the Economic and Financial Crimes Commission (EFCC) on February 18, 2026, but was subsequently taken into ICPC custody the following day. The ICPC secured a 14-day remand order from a Magistrate Court in Bwari, Abuja, allowing them to hold the former governor until March 5, 2026.
However, since the expiration of the remand order, El-Rufai’s legal team and supporters have demanded his immediate release, arguing that his continued detention lacks legal backing. His lawyers have petitioned the ICPC chairman, seeking N15.6 billion in damages for what they term an infringement of his fundamental rights.
Legal Experts Weigh In
Legal practitioners across Nigeria have expressed alarm over the situation, stressing that prolonged detention without formal charges undermines the principles of constitutional democracy. Barrister Abba Hikima emphasized that investigations should precede arrests, not the other way around. “You don’t arrest someone and then start investigating. Investigation should come first,” he said.
Barrister Huwaila Muhammad Ibrahim, Chairperson of the Women Forum of the Nigerian Bar Association, echoed this sentiment, noting that investigative agencies are expected to present suspects before a court within 24 hours unless granted an extension. “The ICPC should return to the court if they need more time,” she stated.
Salman Jawondo, a Senior Advocate of Nigeria (SAN), warned that detaining suspects longer than legally permitted raises serious legal concerns. “Detention should not be punitive. We must create a level playing field when investigating crimes,” he said.
Political Backlash
The African Democratic Congress (ADC), El-Rufai’s political party, has joined the chorus of voices calling for his release. ADC National Publicity Secretary Bolaji Abdullahi criticized the ICPC’s actions, describing them as a “brazen affront to the rule of law.” He added, “Fighting corruption through corrupt and corrupted means is the worst form of corruption.”
El-Rufai’s son, Bello El-Rufai, issued a statement on Friday, demanding his father’s immediate release. “The 14-day period has now ended. The ICPC has not charged him with any offense in a competent court,” he said.
El-Rufai’s Allegations
El-Rufai has maintained that the investigation against him is politically motivated. He has also challenged the legality of a search conducted at his Abuja residence on February 19. Despite these claims, the ICPC has yet to publicly respond to the allegations or clarify its legal basis for continuing his detention.
Atedo Peterside, founder of Stanbic IBTC Bank Plc, condemned the situation, accusing the ICPC, DSS, and EFCC of violating the Nigerian Constitution. In a post on X, Peterside wrote, “Some of us have watched in disbelief as government agencies appear to have conspired to incarcerate El-Rufai without charging him to court.”

Legal experts stress that the commission must either formally charge El-Rufai, seek a fresh detention order, or release him immediately to comply with the law.
